In the last several years, access to accurate and affirming identity documents has become a central issue in the fight for transgender rights across the United States.
Right now, the status of passports for transgender people is confusing and unclear. Now that the Supreme Court has allowed the Trump Administration’s 2025 policy to continue, anyone who applies for a new, corrected, or replacement passport, or for a passport renewal, is at risk of having their passport issued bearing the sex they were assigned at birth. While we continue to fight to reverse this policy, the information below can help guide you or a loved one at this time.
If you have received a passport with an incorrect gender marker since June 17, 2025 or hold a passport with an “X” designation and have experienced trouble traveling, the ACLU Foundation wants to hear from you. Please tell us by filling out the form.
